Ignis BOSCO is operated by Jennifer Wilby, trading as ignis BOSCO (the “Supplier”, “we”, “us”, “our”).  Business address located in Ilkley, West Yorkshire.  

These Terms and Conditions apply to all purchases made through our website or directly with us.  

Eligibility 

By placing an order, you confirm that: 

  • You are at least 18 years old  

  • You are legally capable of entering into a binding contract 

Definitions 

Customer means an individual acting for purposes which are wholly or mainly outside their trade, business, craft or profession; 

Contract means the legally binding agreement between you and us for the supply of Goods;  

Delivery Location means the Customer’s premises or other location where the Goods are to be supplied, as set out in the Order; 

Durable Medium means paper or email, or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored; 

Goods means the goods advertised on the Website that we supply to you of the number and description as set out in the Order; 

Order means the Customer’s order for the Goods from the Supplier as submitted following the step-by-step process set out on the Website; 

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website; 

Website means our website www.ignisbosco.co.uk on which the Goods are advertised. 

Goods 

The description of the Goods is as set out on the Website, catalogues, brochures or other forms of advertisement. Any description is for illustrative purposes only. 

All Goods are handmade using natural materials.  

 As a result, variations in: 

  • Colour 

  • Grain 

  • Texture 

  • Size 

 Are normal and not defects.  

Measurements are approximate unless stated otherwise.  

 Custom or personalised items are made to your specifications. You are responsible for ensuring that all details provided are accurate.  

All Goods are subject to availability.  

We can make changes to the Goods which are necessary to comply with any applicable law or safety requirements.  

 

Order Process & Contract Information 

Product listings do not constitute a binding offer.  

A Contract is formed when: 

You place an Order; and  

We accept it (usually when full payment is received) 

We reserve the right to refuse any orders.  

It is your responsibility to ensure your Order details are correct.  

 We reserve the right to decline orders that contain inappropriate or copyrighted material. 

Price & Payment 

All prices are listed in GBP.  

Prices exclude delivery unless stated.  

Payment must be made in full before dispatching.  

 Delivery 

Estimated processing times: 

Standard items: 3-5 working days 

Custom items: As agreed 

Delivery is made via Royal Mail or courier.  

Risk passes to you upon delivery.  

If an item is lost in transit, we will assist with resolving the issue with the courier.  

Your Right to Cancel 

You have the right to cancel your order within 14 days of receiving the goods.  

This does not apply to: 

Custom made or personalised items 

To cancel, you must notify us clearly (e.g. email) 

You must return the goods within 14 days of cancellation.  

You are responsible for return postage costs unless the item is faulty.  

Refunds will be issued within 14 days of receiving returned goods.  

We may reduce your refund if goods show signs of unnecessary handling.  

Return Policy 

Standard items may be returned within 14 days of delivery. Items must be unused and in their original condition. 

Custom‑made and personalised items are non‑refundable unless faulty.  

Faulty Goods Policy 

You are entitled to goods that are:

If goods are faulty, you may be entitled to:

Refund 

We will cover return postage for confirmed faults.  

Warranty 

We provide a 6-month warranty from delivery covering defects in materials and workmanship.  

All warranty claims must be submitted in writing with photographic evidence within the warranty period. 

The following are excluded:  

  • Commercial use unless agreed in writing  

  • Damage caused by lack of maintenance  

  • Damage caused by detergents, abrasives, or unsuitable cleaning agents  

  • Natural wood movement (shrinkage, swelling, hairline cracks)  

  • Fair wear and tear  

  • Goods installed by third parties  

This warranty is in addition to your legal rights.  

Seasonal expansion, contraction, small gaps or minor shakes are natural and not defects.  

Liability 

Nothing in these Terms limits or excludes liability for: 

Death or personal injury caused by negligence 

Fraud or fraudulent misrepresentation 

Any liability that cannot legally be excluded 

 

Subject to the above, we are not liable for: 

Losses not reasonable foreseeable 

Losses caused by misuse of the Goods 

Losses caused by failure to follow instructions 

 

We are not liable for defects, injury, loss, or damage resulting from negligence, improper installation, unsuitable environments, lack of maintenance, accidents, unauthorised alterations, or third‑party workmanship. 

 

This warranty applies only to the original purchaser and is not transferable

Our total liability shall not exceed the price for the Goods.  

Nothing in these Terms affects your statutory rights.  

 

CLIMBING HOLDS SAFETY & LIABILITY POLICY 

Important Notice 

Climbing activities carry inherent risks, including serious injury or death.  

By purchasing and using our climbing holds, you acknowledge and accept these risks.

Intended Use 

Our climbing holds are designed for: 

Home training boards 

Personal, non commercial use 

 

They are not designed for: 

Commercial gyms 

Public use 

High frequency use 

Children  

 Installation 

You are responsible for:  

Installation onto a structurally sound surface.   

Correct fixings are used 

Installation is carried out safely 

We do not provide installation services and do not accept responsibility for installation carried out by you or a third party.  

Inspection & Maintenance 

You must regularly inspect climbing holds for: 

  • Cracks 

  • Wear 

  • Loosening 

  • Movement 

If any damage or instability is observed, use must stop immediately. Failure to maintain or inspect the holds may result in increased risk of injury or death.  

Use & Responsibility 

You are responsible for: 

Safe use of the product 

Ensuring all users understand the risks 

Children are supervised 

Using appropriate safety measures 

Limitation of Liability (Climbing Use) 

We are not liable for injury or damage arising from: 

Incorrect installation 

Unsuitable surfaces 

Misuse or overloading 

Failure to maintain or inspect 

Unauthorised modifications 

Environmental conditions 

Legal Rights 

Nothing in this section limits your rights under applicable product liability law.  

If a product is defective, your statutory rights apply.  

Privacy 

We process personal data in accordance with UK data protection laws.

Events Outside Our Control 

We are not liable for delays or failures caused by events beyond our reasonable control.  

 Governing Law 

The Contract (including any non-contractual matters) is governed by the law of England and Wales.  

Disputes can be submitted to the jurisdiction of the courts of England and Wales, or where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.  

We try to avoid any dispute, so we deal will complaints the following way: 

  • If a dispute occurs customers should contact us to find a solution. We will aim to respond with an appropriate solution within 5 days.

1.1 Your access to and use of www.ignisbosco.co.uk (“the Website”) and any Services referred to in Clause 2, is subject to these Terms and Conditions. You will not use the Website/Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the Website/Services.  

1.2 We reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Website/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.

The Website may provide communication tools such as email, bulletin boards, chat areas, new groups, forums and/or other message or communication facilities (“the Services”) designed to enable you to communicate with others. Unless stated otherwise the Services are for your personal and non-commercial use only.

We are committed to maintaining the privacy of our users and maintaining the security of any personal information received from you. If you register for any of the Services you will be asked to provide basic personal information. The information provided by you is not available for sale or use by third parties. The information is used solely for notifying you of changes or updates to the Website/Services.  

4. Acceptable Use 

4.1 You acknowledge that all information, text, graphics, logos, photographs, images, moving images, sound, illustrations and other materials (“the Content”), whether posted publicly or transmitted privately, are the sole responsibility of the person from whom such Content originated.  

4.2 In using the Website/Services you agree not to:  

4.2.1 Use the Services to send junk email, spam, chain letters, pyramid schemes or other unsolicited messages, commercial or otherwise;  

4.2.2 Post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful.  

4.2.3 Use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party;  

4.2.4 Make available or upload files that contain a virus, worm, Trojan or corrupt data that may damage the operation of the computer or property of another.  

4.2.5 Impersonate any person or entity for the purpose of misleading others

4.2.7 Use the Website/Services in any manner that could damage, disable, overburden or impair the Website/Services or interfere with any other party’s use and enjoyment of the Website/Services 

4.2.8 Attempt to gain unauthorised access to any of the Services, other accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.  

5 Termination 

We have the right to terminate your access to any of all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to the Website/Services.  

6 Internal Use 

You agree to comply with all applicable laws regarding the transmission of technical data exported from the United Kingdom or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the internet.  

7 Intellectual Property Rights 

7.1 The Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website and the Services) are protected by copyright, trademarks, patents and other intellectual property rights and laws. In accessing the Website you agree that you will access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder.  

7.2 www.ignisbosco.co.uk does not claim ownership of any materials you post, upload or submit to any publicly accessible area of the Services. However, by doing so you are granting us a world-wide, royalty free, non-exclusive license to copy, distribute, transmit, reproduce, publicly display, edit, translate or publish such Content for as long as you elect to display such Content via the Services. The license shall be terminated when such Content is deleted from the Services.  

8 Indemnity 

You agree to indemnify www.ignisbosco.co.uk harmless from and against any breach by you of these Terms and Conditions and any claim or demands brought against www.ignisbosco.co.uk by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through Services, including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by www.ignisbosco.co.uk in consequence of your breach of these Terms and Conditions.  

9 Disclaimers and Limitation Liability 

9.1 Use of the Website/Services is at your own risk. The Website/Services are provided on an “AS IS “and “AS AVAILABLE” basis without any representation or endorsement made any without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.  

9.2 To the extent permitted by law, www.ignisbosco.co.uk will not be liable for any indirect or consequential loss or damage whatsoever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website/Services.  

9.3 www.ignisbosco.co.uk  makes no warranty that the Website/Services will meet your requirements, that Content will be accurate or reliable, that the functionality of the Website/Services will be uninterrupted or error free, that defects will be corrected or that the Website/Services or the server that makes them available are free of viruses or anything else which may be harmful or destructive.  

9.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of www.ignisbosco.co.uk for death or personal injury as a result of the negligence of www.ignisbosco.co.uk 

9.5 Nothing in these Terms and Conditions shall affect your statutory rights as a consumer.  

10 Severance 

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable. 

11 Governing Law 

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdictions of the English courts.
